Petro Allowed to Intervene in Challenge to Ohio's Sex Offenders Eviction Law

Attorney General Jim Petro announced yesterday that a federal judge granted his request on Saturday to allow the state to help defend against a new constitutional challenge to a state law allowing local prosecutors to seek evictions of sex offenders living within 1,000 feet of a school.

The case, Lane Mikaloff, Plaintiff v. Sherri Bevan Walsh, et. al., Defendants, challenging the constitutionality of Ohio Revised Code Section 2950.031, is being heard in U.S. District Court for the Northern District of Ohio, Eastern Division. Walsh is the Summit County Prosecutor. Along with granting Petro's request, the court set a hearing on a plaintiff’s motion for a temporary restraining order and preliminary injunction against enforcement of the law for 11:30 a.m., Feb. 10 in U.S. District Court in Akron.
